Facts about House Bill 437

Marriage has always been understood to fundamentally be -

the union of a man and a woman.

HB 437 is a bill currently under consideration in the New Hampshire legislature that will return the definition of marriage in our state back to its original meaning.

The plain fundamental meaning of the word marriage has always been understood to be the union of a man and a woman.  This legislation is intended to preserve that basic understanding about marriage while protecting the rights and benefits of people in other types of care-giving relationships using civil union contracts.

 

When passed, HB 437 will do the following

  • restore the language in our state laws that defined marriage as "the union of one man and one woman"

  • continue to recognize as valid ALL existing marriages

  • make inclusive civil unions available to all unmarried adults

  • extend religious freedom protections in the current marriage law to civil union agreements

HB 437 will NOT

  • allow incest

According to state law (RSA 639:2),  in NH  incest is a felony crime - punishable by up to 20 years in prison.  That law is unaffected by HB 437 so there is no legitimate reason to claim this legislation allows incest.

A civil union is NOT intended to be a substitute for marriage and does not presuppose a romantic relationship.  It is "a contractual agreement that provides reciprocal benefits and obligations for the parties to the agreement". 

  • invalidate anti-discrimination laws

The state's anti-discrimination laws (RSA 354-A) will remain unchanged by HB 437.  However, this bill does include protection for people's religious freedom and rights of conscience similar to what Governor Lynch put in the current marriage law (RSA 457:37).

Opponents of HB 437 are trying to sour support for this legislation by misrepresenting what the bill will do.  Do not allow yourself to be influenced by fear mongering tactics, these false claims have NO basis in reality.  See link below to read the bill for yourself.
